1. Introduction; Agreement to Terms
1.1 These Terms of Use (“Terms”) govern your access to and use of the MEYBRIAH website available at meybriah.com (the “Site”) and any products, services, content, features, or functionality offered through it (collectively, the “Services”).
1.2 By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site or the Services.

3.2 By using the Site, you represent and warrant that (a) you are legally permitted to use the Site; (b) you have authority to enter into these Terms; and (c) all information you provide is true, accurate, current, and complete.

4.1 Certain features may require registration or account creation. You are responsible for safeguarding your credentials and for all activity under your account. Do not share your login details with any third party.
4.2 We may suspend, limit, or terminate access or accounts at our discretion, including in cases of suspected misuse, security risk, breach of these Terms, fraud, or unlawful conduct.

5.1 Product descriptions, specifications, pricing, availability, shipping options, delivery times, and any additional fees are shown on the relevant product pages and/or during checkout. Prices include VAT where applicable unless stated otherwise.
5.2 An order constitutes your offer to purchase. We may accept or reject any order at our discretion (e.g., stock constraints, verification, pricing issues). An order is deemed accepted only when we send written order confirmation.
5.3 Payments are processed by secure third‑party providers. Orders are processed subject to payment authorization and anti‑fraud checks.
5.4 Israeli consumer‑protection disclosures: Key information (identity of the trader, product description, price incl. VAT, delivery costs/times, payment terms, cancellation/return policy, and contact details) appears on product/checkout pages or linked policies. Statutory cancellation rights for “distance sales” apply as detailed in our Returns & Cancellations Policy (see section 10.3) and subject to legal conditions and exceptions.
6. Wellness Framework; No Medical Advice
6.1 Our products are offered within a wellness‑oriented framework. They are not medical devices and are not intended to diagnose, treat, cure, prevent, or mitigate any disease or medical condition, and are not a substitute for professional medical advice, diagnosis, or treatment. If you have medical concerns, consult a licensed healthcare professional.
6.2 Individual experiences may vary. To the maximum extent permitted by law, use of the Site and products is at your own discretion and risk.
7. Permitted Use; Prohibited Conduct
7.1 You may use the Site only for lawful, personal, and non‑commercial purposes and in accordance with these Terms and applicable law.
7.2 You must not: (a) copy, reproduce, distribute, publicly perform/display, or create derivative works from Site content without prior written permission; (b) use the Site for any unlawful, infringing, fraudulent, or harmful purpose; (c) interfere with or disrupt the operation or security of the Site; (d) upload or distribute malware or harmful code; (e) conduct scraping, data mining, robots, spiders, or automated extraction/indexing without our prior written authorization; (f) reverse engineer, decompile, or attempt to access the Site’s source code or underlying methods except where such restriction is prohibited by law; (g) infringe the rights (including privacy and IP) of MEYBRIAH or any third party.

8.1 All content and materials on the Site—including text, images, graphics, logos, videos, designs, trademarks, service marks, trade names, industrial designs, software, code, methods, and technologies—are owned by MEYBRIAH or its licensors and are protected under applicable laws. No rights are granted except the limited right to use the Site in accordance with these Terms.
8.2 Any feedback or suggestions you provide may be used by us without restriction or obligation to you.
9. Privacy; Cookies; Direct Marketing (Israel)
9.1 Privacy. Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, share, secure, store, and transfer personal information, and how to exercise rights under Israeli law (review/correction/deletion).
9.2 Cookies/Consent. Non‑essential cookies (e.g., analytics/marketing) are activated only after your explicit consent via our cookie‑consent banner. You can change preferences at any time. Disabling certain cookies may affect Site functionality.
9.3 Direct Marketing (Section 30A). “Advertisements” as defined in Israeli law are sent only with prior explicit consent; we keep consent/opt‑out records. Each marketing message will clearly identify itself as an advertisement, include sender details, and provide a simple, free, and immediate unsubscribe method. Service/transactional notices (e.g., order confirmations) may still be sent.
10. Returns; Cancellations; Consumer Rights (Israel)
10.1 We honor your statutory rights under the Israeli Consumer Protection Law and regulations, including rights applicable to distance sales, subject to legal conditions and exceptions (e.g., perishable goods, customized items, hygiene‑sensitive items once unsealed, and other exceptions defined by law).
10.2 Return shipping, timelines, restocking limits (if any), and refund method are handled in accordance with applicable law and as detailed in our Returns & Cancellations Policy.

15. Limitation of Liability (Subject to Mandatory Law)
15.1 To the fullest extent permitted by applicable law, MEYBRIAH and its owners, officers, directors, employees, consultants, affiliates, partners, suppliers, and licensors are not liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising out of or related to (a) use of or inability to use the Site; (b) products; (c) errors, interruptions, or security incidents; (d) third‑party conduct, cyber incidents, or unauthorized access—even if advised of the possibility of such damages.
15.2 Nothing in these Terms limits liability where such limitation is prohibited by law (including liability under the Israeli Defective Products Liability Law for bodily injury caused by a defective product, certain consumer‑protection liabilities, fraud, willful misconduct, or gross negligence). If liability is imposed despite the foregoing, and to the extent permitted by law, our aggregate liability will be limited to the amount actually paid by you for the product or service giving rise to the claim.
16. Indemnification
You agree to indemnify and hold harmless MEYBRIAH and its owners, directors, officers, employees, consultants, affiliates, and agents from and against any third‑party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from (a) your use of the Site; (b) your breach of these Terms; or (c) your violation of applicable law or third‑party rights. This section does not apply to the extent deemed an “unfair term” under Israeli law.
17. Force Majeure
We will not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including war, hostilities, national emergency, embargo, pandemic, natural disaster, strike/lockout, widespread communications or infrastructure failures, orders of authorities, changes in law, or critical supplier outages. Performance will resume as soon as reasonably practicable once the event ends.
18. Changes to the Site and to These Terms
18.1 We may modify, suspend, or discontinue the Site (in whole or in part) at any time, provided existing legal obligations are honored.
18.2 We may update these Terms from time to time. The “Last updated” date will change accordingly. Material changes will be reasonably highlighted on the Site before taking effect when legally required. Continued use after the effective date constitutes acceptance of the updated Terms.
19. Governing Law; Jurisdiction
These Terms and any dispute arising out of or relating to the Site, products, or Services are governed by the laws of the State of Israel, without regard to conflict‑of‑law rules. The competent courts in Tel Aviv–Jaffa, Israel, will have exclusive jurisdiction, subject to any non‑waivable consumer venue rights and review of “unfair terms” under Israeli law.
20. Miscellaneous
20.1 Severability. If any provision is found illegal, void, or unenforceable, the remaining provisions will remain in full force and the invalid provision will be enforced to the maximum extent permitted to reflect the parties’ intent.
20.2 No Waiver. Failure to enforce any right does not constitute a waiver of that right.
20.3 Assignment. We may assign or transfer our rights and obligations under these Terms to a third party, subject to applicable law and without materially prejudicing your statutory rights. You may not assign your rights or obligations without our prior written consent.
20.4 Entire Agreement. These Terms, together with the Privacy Policy and any policies referenced herein (including Returns & Cancellations and Accessibility Statement), constitute the entire agreement regarding your use of the Site and supersede any prior understandings on that subject.
20.5 Interpretation; Language. Headings are for convenience only and do not affect interpretation. This English version governs in case of discrepancy with any translation posted for convenience.
